ARTICLE 29: PROTECTION OF INTERESTS OF MINORITIES

The term ‘minority’ has not been defined anywhere in the constitution. It is accepted that minority refers to both religious and linguistic minorities.

Clause 1: It says that any section of citizens residing in any part of the territory of India has the right to preserve Their Language, Script And Culture. It does not discriminate between majority and minority and it is available to all sections of citizens having distinct language, script and culture of their own. This right is absolute.

Clause 2: It says that no citizen shall be denied admission to educational institutions funded wholly or aided partially by the State on the grounds only Of Religion, Race, Caste, Language or any of them

This right is available to individual citizens not to a community as a whole.

Article 30: RIGHT OF MINORITIES TO ESTABLISH AND ADMINISTER EDUCATIONAL INSTITUTIONS

Clause 1: It says that both the religious and linguistic minorities have the right to establish and administer educational institutions of their own.

Note: The minorities need not establish educational institutions of their own to conserve their language, script or culture. They may impart a system of education that is unconnected with their language, script or culture.

Clause 1 talks about two things:

  1. To Establish
  2. To Administer

For an educational institution to acquire minority status, it has to be established and administered by a minority community. Institutions such as the Aligarh Muslim University and Jamia Millia Islamia, established by an act of Parliament do not qualify as minority institutions.

Note: The admission to a minority institution is restricted to the members of that particular community.

Administration of minority institutions deals with managing and conducting the affairs of such institutions. It is subjected to reasonable restrictions. The universities can impose reasonable restrictions upon the minority institutions that come under its jurisdiction to maintain the standard and efficiency of education.

Sub Clause(a): It says that the State, on acquiring the properties that belong to a minority educational institution shall compensate it with an amount of money that will enable the continuance of administration without any restrictions.

Clause 2: It talks about the right of the minority institutions to not to be discriminated against by the State in granting financial assistance. The State has to treat both the minority and majority institutions equally while granting financial aid. But the minority institutions can not claim financial aid as a matter of right from the State.

ARTICLE 32: RIGHT TO CONSTITUTIONAL REMEDIES

Dr.B.R. Ambedkar called article 32 as ‘The Heart And Soul Of The Constitution’ appreciating its significance. The provisions of this article empower the individuals to seek judicial remedies when their fundamental rights are denied.

As the protection under the articles 14, 20, 21, 21A, 22, 23, 24, 25, 26, 27 and 28 are available to both citizens and friendly aliens, in the case of violation of any of these rights, the friendly aliens can also seek judicial remedies.

Clause 1: It says that the individuals have the right to move to the Supreme Court for the enforcement of Fundamental Rights guaranteed to them in Part III of the constitution.

Clause 2: For the enforcement of the rights guaranteed in Part III, the Supreme Court can issue directions or orders or writ, whichever is appropriate.

Writ: A writ is a formal, written order, issued by an authority for providing quick remedy against injustice. All writs are orders but not all orders are writs.

PIL(Public Interest Litigation): A PIL is a kind of writ, aimed at general public interest not at the interest of one particular litigant.

A writ can be issued either to enforce an action or stop an action. There are five types of writs issued by the Supreme Court under article 32 and High Courts under article 226.

இந்த விதிமுறையை நடைமுறைக்குக் கொண்டுவர குறைந்தபட்ச ஊதியச் சட்டம் (1948), தொழிற்சாலைகள் சட்டம் (1948), சுரங்கச் சட்டம் (1952) போன்ற சட்டங்கள் இயற்றப்பட்டுள்ளன.

குறிப்பு: இந்த ஏற்பாட்டின் இரண்டாம் பகுதி குடிசைத் தொழில்களை மேம்படுத்துவது பற்றி பேசுகிறது, இது காந்திய கொள்கைகள் பிரிவின் கீழ் உள்ளது.

பிரிவு 43 : எந்தவொரு தொழிற்துறையிலும் ஈடுபட்டுள்ள நிறுவனங்கள் மற்றும் அமைப்புகளின் நிர்வாகத்தில் தொழிலாளர்களின் பங்களிப்பை செயல்படுத்த இது அரசை வழிநடத்துகிறது. இந்த கட்டுரை 1976 ஆம் ஆண்டின் 42 வது அரசியலமைப்பு திருத்தச் சட்டத்தால் சேர்க்கப்பட்டது.

தேசிய சுகாதார கொள்கை 2017, ராஷ்டிரிய ஸ்வஸ்திய பீமா திட்டம், குடும்ப நல திட்டங்கள் மற்றும் பலவற்றை இந்த வகையில் வகுத்து செயல்படுத்தப்படுகின்றன.

காந்திய கோட்பாடுகள்

பிரிவு 40: அரசு கிராம பஞ்சாயத்துகளை ஒழுங்கமைத்து அவர்களுக்கு தேவையான அதிகாரங்களையும் அதிகாரத்தையும் அளிக்கும், இதனால் அவை சுயராஜ்யத்தின் அலகுகளாக செயல்பட முடியும் என்று அது கூறுகிறது.

இது சம்பந்தமாக, 73 வது அரசியலமைப்பு திருத்தச் சட்டம் 1992 இல் இயற்றப்பட்டது, இது கிராம பஞ்சாயத்துகளுக்கு பகுதி IX இன் பிரிவு 243 ன் கீழ் அரசியலமைப்பு அந்தஸ்தை வழங்குகிறது. கிராம பஞ்சாயத்துகளின் அதிகாரங்களும் செயல்பாடுகளும் அரசியலமைப்பின் பதினொன்றாவது அட்டவணையில் குறிப்பிடப்பட்டுள்ளன.

பிரிவு 43: கிராமப்புறங்களில் குடிசைத் தொழில்களை தனிப்பட்ட அடிப்படையில் அல்லது கூட்டுறவு அடிப்படையில் ஊக்குவிக்க இது அரசை வழிநடத்துகிறது.

இது தொடர்பாக நிறுவப்பட்ட சில நிறுவனங்கள் பின்வருமாறு

  1. காதி மற்றும் கிராம தொழில் வாரியம்
  2. காதி மற்றும் கிராம தொழில் ஆணையம்

பிரிவு 43 பி: தன்னார்வ உருவாக்கம், தன்னாட்சி செயல்பாடு, ஜனநாயக கட்டுப்பாடு மற்றும் கூட்டுறவு சங்கங்களின் தொழில்முறை மேலாண்மை ஆகியவற்றை ஊக்குவிக்க இது அரசை வழிநடத்துகிறது.

இந்த பிரிவு கூட்டுறவு சங்கங்களுக்கு அரசியலமைப்பு அந்தஸ்தை வழங்கும் 97 வது அரசியலமைப்பு திருத்தச் சட்டம் 2011 ஆல் சேர்க்கப்பட்டது. திருத்தச் சட்டம் அரசியலமைப்பில் மூன்று மாற்றங்களைச் செய்தது. அவை

  1. கூட்டுறவு சங்கங்களை உருவாக்குவதற்கான உரிமை கட்டுரை 19 (1) (சி) இன் கீழ் ஒரு அடிப்படை உரிமையாக மாற்றப்பட்டது, இது சங்கங்கள் அல்லது தொழிற்சங்கங்கள் அல்லது கூட்டுறவு சங்கங்களை உருவாக்குவதற்கான சுதந்திரத்தை உறுதி செய்கிறது.

பிரிவு 43 பி இன் கீழ் ஒரு புதிய உத்தரவுக் கொள்கை பகுதி IV இல் செருகப்பட்டது.

  1. ஒரு புதிய பகுதி, பகுதி IXB செருகப்பட்டது, இது கூட்டுறவு சங்கங்களின் உருவாக்கம், நிர்வாகம் மற்றும் பிற அம்சங்களைக் கையாள்கிறது.

  3. எஸ்.சி மற்றும் எஸ்.டி.க்களின் சிவில் உரிமைகளைப் பாதுகாக்க சிறப்புச் சட்டங்கள் இயற்றப்பட்டன, அதாவது பட்டியல் சாதிகள் மற்றும் பட்டியல் பழங்குடியினர் (அட்டூழியங்களைத் தடுக்கும்) சட்டம், 1989,

தீண்டாமை சட்டம், 1955, முதலியன.

பிரிவு 47: ஆரோக்கியத்திற்கு தீங்கு விளைவிக்கும் போதைப்பொருள் மற்றும் போதைப்பொருட்களை உட்கொள்வதை முற்றிலுமாக தடை செய்யுமாறு இது அரசுக்கு அறிவுறுத்துகிறது.

பிரிவு 48: பசுக்கள் மற்றும் கன்றுகள் மற்றும் பிற பால் மற்றும் வரைவு விலங்குகளை படுகொலை செய்வதை தடை செய்வதற்கான நடவடிக்கைகளை எடுக்கவும், அவற்றின் இனங்களை மேம்படுத்தவும் இது அரசுக்கு அறிவுறுத்துகிறது.
